64B8-2.001: Definitions

The Board of Medicine hereby gives notice that on October 21, 2010, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver was filed on behalf of Simon B. Santos, M.D. on August 9, 2010, seeking a waiver from Rule 64B8-2.001, F.A.C., with regard to the requirement for the passing score on the FLEX examination to be obtained in one administration of the examination. The Notice was published in Vol. 36, No. 33, of the Florida Administrative Weekly, on August 20, 2010. The Board, at its meeting held on October 2, 2010 voted to grant the Petition for Waiver finding that the Petitioner demonstrated a substantial hardship; that application of the rule would violate the principles of fairness; and that he has met the purpose of the underlying statute.
