40E-6.221Conditions for Issuance of Standard Permits

The South Florida Water Management District (District) hereby gives notice: On September 14, 2023, the District's Governing Board issued SFWMD Order No. 2023-051-DAO-ROW to Collier County Transportation Engineering Division (Application No. 230501-38473). The petition for waiver was received by the District on May 31, 2023. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Register, Vol. 49/159 on August 16, 2022. No public comment was received on this item. This Order provides a waiver of the District's criteria for the construction of a bridge over the Golden Gate Main Canal with a reduced vertical clearance; Collier County. Specifically, the Order grants a waiver from paragraph 40E-6.221(3)(j), Fla. Admin. Code, which governs the vertical clearance of bridges within Works or Lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver as follows: 1) the proposed construction will not interfere with the District's current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.
