NOTICE IS HEREBY GIVEN that Florida Department of Health has issued an order disposing of the petition for declaratory statement filed by Crystal Lagoons U.S. Corp. on June 15, 2018. The following is a summary of the agency’s disposition of the petition:
The agency granted the petition and ordered that bodies of water created and operated by Crystal Lagoons’ licensees using a process that was patented in the name of Crystal Lagoons, as owner, and recorded by the United States Patent and Trademark Office as of the date of the filing of the Petition are “public bathing places” as that term is defined by subsection 514.011(4), Florida Statutes (2017).
