6A-2.0040Sanitation Standards in K-12 Private Schools

The Department of Education hereby gives notice: that on June 16, 2020, the Office of the Clerk for the Department of Education received a Petition for Variance from subsection 6A-2.0040(7), F.A.C., Sanitation Standards in K-12 Private Schools. The petition requests a long-term variance permitting the school to provide drinking water for students in a format other than the slant jet type drinking fountains prescribed by rule. The petitioner is The Element Montessori, f/k/a Flagler Beach Montessori School, located in Bunnell, Florida. Notice of the petition was published in Vol. 46, No. 125, F.A.R, on June 26, 2020. Having received no comment on the petition, the order on this petition was executed on September 2, 2020. After a complete review of the petition, the Department finds that the rule, as applied, will create a financial hardship for Petitioner. The Department further finds that Petitioner’s proposed alternative scheme would adequately address the concerns and purpose set forth by the rule’s underlying statutes. Petitioner shall strictly adhere to the operating procedures outlined and adopted by the order, and shall maintain a copy at its location during all periods of operation.
