Division of Florida Land Sales, Condominiums and Mobile HomesNOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Indian Lake Estates, Inc., Docket No. 2008043021 on July 24, 2008. The following is a summary of the agency’s declination of the petition: The Division declined to issue an order because the Division does not have general authority to interpret or enforce Chapter 720, F.S., and there is no need for the Division to issue a declaratory statement because Indian Lakes Estates’ status is not in doubt; an arbitrator has already determined that it is not a homeowners’ association subject to Chapter 720, Florida Statutes.
