    11B-35.002Basic Recruit Training Programs for Law Enforcement, Correctional, and Correctional Probation

    NOTICE IS HEREBY GIVEN that on August 31, 2017, the Florida Department of Law Enforcement, received a petition for a temporary emergency waiver of paragraph 11B-35.002(2)(a), F.A.C., from Sergio Fernandes Martins. Petitioner wishes to temporarily waive that portion of the Rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination pursuant to rule 11B-30.0062, F.A.C., and gain employment and certification as an officer. In justification of his petition for waiver, Petitioner asserts that he began a commission-approved Basic Recruit Training Program in March of 2013 and passed the State Officer Certification Examination (“SOCE”) in August of 2013, but, because he was caring for an ill father and working to provide for his family, he was unable to obtain an offer of employment until May of 2017 when he submitted an application to the Holly Hill Police Department (“HHPD”). The HHPD made Petitioner a conditional offer of employment and completed his pre-employment screening but is now unable to activate Petitioner’s certification because, unfortunately, Petitioner’s four-year employment window expired in March of 2017. However, Petitioner asserts that the HHPD hopes to officially hire Petitioner should the emergency waiver be granted. Petitioner also alleges that, should the waiver not be granted, Petitioner will suffer a substantial hardship as he would have to undergo another Basic Recruit Training Program and pass another SOCE, resulting in both a financial burden and stress for his family. However, after a review of the Petition, FDLE determined that the Petition is not an emergency and that it shall be reviewed by FDLE on a non-emergency basis.
