    The Department of Business and Professional Regulation, Division of Pari-Mutuel Wagering (“Department”) hereby provides notice of renewal of Emergency Rule 61DER17-1, Procedures for Collecting Samples from Racing Animals, as adopted on March 24, 2017, and noticed in the Florida Administrative Register on March 24, 2017, Vol. 45/58 with a renewal published on June 7, 2017 in the Florida Administrative Register.  On April 27, 2017, the Department published a Notice of Proposed Rule pursuant to Section 120.54(3)(a)1., Florida Statutes, in the Florida Administrative Register for Proposed Rules 61D-6.0051, 61D-6.0052, and 61D-6.006, to adopt permanent rules regarding sample collection and split sample procedures of pari-mutuel racing animals for purposes of the analysis and detection of permissible and impermissible substances in the race-day specimen of an animal in order to make a determination of potential violations of Section 550.2415, F.S.  On June 2, 2017, a petition was filed with the Division of Administrative Hearings challenging the proposed rules, DOAH Case No. 17-3251RP; this challenge remains pending.  Pursuant to Section 120.54(4)(c)1., Florida Statutes, Emergency Rule 61DER17-1, Florida Administrative Code, is renewed.
