    Notice is hereby given that the Board of Medicine has received a Petition for Declaratory Statement filed on behalf of Ara J. Deukmedjian, M.D., on August 23, 2011. The Petitioner requests the Board’s interpretation of Section 456.44, Florida Statutes, as created in Section 3 of Chapter 2011-122, Laws of Florida. Specifically, the Petitioner asks the Board to find that the prescribing of controlled substances for the treatment of pain during the usual course of the disease or injury causing such pain is not the prescribing of controlled substances for the treatment of “chronic nonmalignant pain” as defined in Section 456.44(1)(d), F.S., and that therefore, Petitioner is not required to register as a controlled substance provider as set forth in Section 456.44(2), F.S., as a result of such prescribing in the treatment of conditions set forth in the Petition. The Board will consider this petition at its meeting scheduled for September 30-October 1, 2011, in Tampa, Florida.
