    NOTICE OF CORRECTION

    Notice is hereby given that the following correction has been made to the proposed rule in Vol. 39, No. 205, October 21, 2013 issue of the Florida Administrative Register.

     

    The Notice of Proposed Rule published in the October 21, 2013, Florida Administrative Register should have read:

     

    SUMMARY OF RULES:

    The proposed amendments are to update sections of Chapter 40B-9, Florida Administrative Code (F.A.C.). The proposed 40B-9.131, F.A.C., amendment includes changes to the Public Use Guide; which is incorporated by reference. Since the publication of the last guide the District has added additional properties. The District is updating the public use guide to add additional recreation opportunities to several tracts. The tracts and the recreational opportunities needed to be added. The proposed 40B-9.139, F.A.C., amendment includes changes to the Public Use Fee Schedule: incorporated by reference under which fees would be imposed on persons who engage in certain activities at specified locations and facilities on District lands. Since the last Public Use Fee Schedule was incorporated the District has added additional facilities and recreational opportunities on specified District lands locations.

    SUMMARY OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RADIFICATION:

    The District has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.

    The District has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: There is neither a cost nor an exemption from cost associated with these rules. The amendments are not expected to require legislative ratification pursuant to subsection 120.541(3), Florida Statutes. The amendments, however, are subject to legislative review pursuant to subsection 373.1391(6), Florida Statutes. Any person, who wishes to provide information regarding the statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so within 21 days of this notice.

     

    40B-9.131 Public Use of District Lands.

    (1) The District shall publish and make available to the public a “SRWMD Public Use Guide” dated June 11, 2013 July 14, 2009, which summarizes allowed activities and use restrictions for each District property or land. The District’s Public Use Guide is hereby incorporated by reference. Copies of the District’s Public Use Guide may be obtained at the District’s headquarters and at the District’s website: www.mysuwanneeriver.com. www.srwmd.state.fl.us.

     

    40B-9.139 Use Fees.

    The District shall publish and make available to the public a “Suwannee River Water Management District Public Use Fee Schedule” which specifies charges for activities on District lands. The charges contained in the District’s Use Fees Schedule shall apply to the uses on District lands as specified therein. The Public Use Fee Schedule, effective June 11, 2013 January 12, 2010, is hereby incorporated by reference. Copies of the fee schedule and a list of designated properties may be obtained at the District’s headquarters or at the District’s website: www.mysuwanneriver.com.
