    61-19.003Application Requirements

    NOTICE OF CORRECTION

     

    Notice is hereby given that the following corrections have been made to summarize the substantive change made to the amended forms with respect to the proposed rule in Vol. 43, Number 217, November 8, 2017, issue of the Florida Administrative Register, and updated with a notice of change published in Vol. 44, Number 09, January 12, 2018, issue of the Florida Administrative Register.

     

    The summaries of amended changes to the forms are as follows:

     

    61-19.003 – Amended Form TA-1:

    The Effective Date of the Form was changed from “March 2016” to “December 2017” to reflect amended changes in the Form.

     

    First unnumbered page, “Application Requirements”: Amended the specific checklist section reference in the Form which directs the applicant where supporting legal documentation that must be submitted.  Thus, the Form was amended to correct the language “See Section (2)(e) of Instructions” to “See Section (2)(d) of Instructions.”

     

    Seventh unnumbered page, “Section IV(a) – Background Questions”: Amended the statement language at the bottom of this section in Form which directs the applicant where supporting legal documentation that must be submitted.  Thus, the language was amended to remove reference to “Section (2)(b) of Instructions” and include “Section (2)(d) of Instructions.”

     

    Eleventh unnumbered page, “Moral Character Affidavit”: Pursuant to Section 468.803(8), Florida Statutes, each application for licensure must be accompanied by at least five “good moral character” affidavits.  Therefore, an oath and/or affirmation statement without the need for witnesses in accordance with Section 559.79, F.S., was added to this page as follows:

     

    "By signing/typing your name below you certify that you are empowered to execute this document. You acknowledge and understand that your signature submitted on this executed document has the same legal effect as an oath or affirmation without the need for witnesses in accordance with Section 559.79, Florida Statutes. Under the penalties of perjury, you declare and say that you have read the foregoing document and swear and/or affirm that the information provided herein is true and correct. You understand that falsification of any material information on this document may result in criminal penalty."

     

    61-19.003(10) – Amended Form TA-2:

    Changed the Effective Date of the Form from “August 2014” to “December 2017” to reflect amended changes in the Form.

     

    First unnumbered page, “Application Requirements”: Amended the specific checklist section reference in the Form which directs the applicant where supporting legal documentation that must be submitted.  Thus, the Form was amended to correct the language “See Section (2)(b) of Instructions” to “See Section (2)(f) of Instructions.”

     

    Seventh unnumbered page, “Section VI(a) – Background Questions”: Amended the statement language at the bottom of this section in Form which directs the applicant where supporting legal documentation that must be submitted.  Thus, the language was amended to remove reference to “Section (2)(b) of Instructions” and include “Section (2)(f) of Instructions.”

    61-19.003(11) – Amended Form TA-3:

    Changed the Effective Date of the Form from “March 2016” to “December 2017” to reflect amended changes in the Form.

     

    First unnumbered page, “Application Requirements”: Amended the specific checklist section reference in the form which directs the applicant the “Talent Agency Name or Location Change" fee amount that must be submitted.  Thus, the Form was amended to correct the proper fee amount as delineated in Section 468.404(3), F.S., by removing “$10” to “$25.”  

     

    First unnumbered page, “Application Requirements”: This checklist section reference in the Form refers to supporting legal documentation that must be submitted, if applicable, and directed the applicant to “see Section (2)(b) of Instructions.”  Thus, the Form was amended to remove reference language “See Section (2)(b) of Instructions” as such language is not provided for in the Form and therefore is unnecessary.
