    RULE NO.: RULE TITLE:

    68A-9.008: Permits for Physically Disabled

    PURPOSE AND EFFECT: The purpose of the proposed rule amendment is to revise the regulations for crossbow permits to include additional allowable methods of take and for alternative mobility permits to include additional qualifying criteria. The effect of the proposed rule amendment will be to enable the agency to better accommodate hunters seeking disabled crossbow or alternative mobility permits.

    SUMMARY: The proposed rule amendments adjust current regulations by expanding the alternative mobility permit (AMP) criteria to include possession of a valid permanent disabled parking placard or a statement from a licensed physician certifying that individuals have a condition that prevents them from walking 200 feet without stopping to rest; and by allowing bows equipped with devices that mechanically hold the string in the drawn position to be allowed by disabled crossbow permit for taking game during archery season.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The nature of the rule and the preliminary analysis conducted to determine whether a SERC was required.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    68A-9.008 Permits for Physically Disabled.

    The executive director or his designee may issue permits, to persons who are permanently physically disabled as described below, for activities which would otherwise be regulated or prohibited by these rules. Such permits shall be conditioned as necessary to protect natural resources and to regulate access in accordance with management plans and policies for the area. Individuals not meeting the criteria for a permit set forth in this rule may request accommodation through the process established by the agency:

    (1) Crossbow permits. Permits to use crossbows or bows equipped with a device that can mechanically hold the bowstring in the drawn (ready-to-fire) position during an archery season will be issued based upon a determination that the applicant has submitted an original certificate from a licensed physician certifying that the individual is permanently incapable of drawing any type of bow with a minimum draw weight of 40 lbs.

    (2) No change.

    (3) Alternative mobility permits. Permits to operate an all-terrain vehicle will be issued based upon a determination that the applicant has been issued and possesses a valid permanent disabled parking placard or has submitted an original certificate from a licensed physician certifying that the individual is mobility impaired in that he or she is one of the following: paraplegic, hemiplegic, quadriplegic, permanently dependent upon a wheelchair for ambulation, permanently required to use braces or prostheses prosthesis on both legs, a recipient of or complete single-leg amputation above the knee, or unable to walk a distance of 200 feet without stopping to rest. “All-terrain vehicle” shall be as defined in Rule 68A-1.004, F.A.C., provided that no two-wheeled or two-cycle vehicles will be permitted.

    (4) No change.
