SUMMARY: The rule sets forth the provisions for the FLAMINGO MULTIPLIER Book Settlement Promotion.

53ER16-6 FLAMINGO MULTIPLIER Book Settlement Promotion.

(1) Beginning Tuesday, January 12, 2016, through Thursday, February 4, 2016, the Florida Lottery will conduct the FLAMINGO MULTIPLIER Book Settlement Promotion (“Promotion”) in which Florida Lottery retailers can earn entries in up to four drawings by settling books of FLAMINGO MULTIPLIER lottery tickets for a chance to win $2,000 prizes. The FLAMINGO MULTIPLIER games included in this Promotion are: Game Number 1296, $10,000 FLAMINGO MULTIPLIER; Game Number 1297, $50,000 FLAMINGO MULTIPLIER; Game Number 1298, $500,000 FLAMINGO MULTIPLIER; Game Number 1299, $2,000,000 FLAMINGO MULTIPLIER; and Game Number 1288, $5,000,000 FLAMINGO MULTIPLIER.

(2) Eligibility and Entry Determination.

(a) Eligibility.  In order to be eligible for a drawing, a retailer must have activated at least one book of each of the five above-listed FLAMINGO MULTIPLIER games.

(b) Entry Determination. A retailer will earn entries in up to four drawings for each new “FLAMINGO MULTIPLIER” full book of lottery tickets the retailer settles before midnight ET on the last day of the settlement period.  The number of entries earned shall be weighted based upon the week in which the book or books are settled. Entries will be cumulative from week to week.  The settlement periods, number of entries earned and drawing dates are shown in the table below.

A retailer who does not immediately activate all five FLAMINGO MULTIPLIER games will earn entries during the Promotion for those FLAMINGO MULTIPLIER books that it activates and settles. However, those entries will be held until all five FLAMINGO MULTIPLIER games are activated, at which time, the entries will be applied and included in the next available drawing.

(3) Drawings and Prizes. On each of the four drawing dates, eighteen retailer drawings, determined by district and retailer category (corporate or independent), will be conducted by the Florida Lottery using a random certified generation process. The number of entries drawn and prizes awarded will be in accordance with the following table:

A total of 104 $2,000 prizes will be awarded in the FLAMINGO MULTIPLIER Book Settlement Promotion.

 

An individual retailer location may win in more than one drawing, but may only win one prize per drawing. Alternate entries will be drawn in each drawing. The number of alternate entries drawn will be twice the number of prizes to be awarded in that drawing. Alternate entries will be used as needed in the order in which they are drawn to award a prize in the event a retailer’s entry is disqualified.  A retailer will be subject to disqualification from a drawing if the Florida Lottery determines that:

(a) the entry is invalid because the retailer settled one or more of the qualifying books of tickets during the promotion period and subsequently unsettled such qualifying book or books of tickets any time up to and including the date of the drawing;

(b) the retailer has already been awarded a prize in that drawing; or

(c) due to non-compliance with Florida Lottery laws, rules or terms of the retailer contract.

(4) Retailers will receive their Promotion prize check within approximately 30 days of the drawing.

(5) Retailers whose Florida Lottery contracts are terminated or inactivated prior to the promotional prize award shall be paid the promotional prize provided; the termination or inactivation was not due to non-compliance with Florida Lottery laws, rules or terms of the retailer contract.

(6) Winning retailers will not be permitted to return or unsettle FLAMINGO MULTIPLIER books of tickets except as determined by the Lottery for occurrences such as a change of ownership, or suspension or termination of retailer contract.

(7) A promotional prize will be considered compensation to the retailer for Internal Revenue Service purposes. The Florida Lottery reserves the right to apply the promotional prize awarded against a retailer’s outstanding debt to the Florida Lottery.

THIS RULE TAKES EFFECT UPON BEING FILED WITH THE DEPARTMENT OF STATE UNLESS A LATER TIME AND DATE IS SPECIFIED IN THE RULE.
