The Board of Clinical Laboratory Personnel hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on July 24, 2023, by Dr. Andreas Mbah. Petitioner was seeking a waiver or variance from paragraph 64B3-5.007(2)(e), F.A.C., regarding education, certification, and training/experience requirements for licensure with a specialty in hematology. The Notice was published in Volume 49, No. 151, of the Florida Administrative Register, on August 4, 2023. The Board considered the Petition at a duly noticed videoconference and telephone conference public meeting held August 4, 2023. The Board’s Order, filed on August 22, 2023, granted the petition finding that Petitioner met the purpose of the underlying statutes by other means and that application of the above rule to Petitioner creates a substantial hardship for violates the principles of fairness.
