    62B-33.024Thirty-Year Erosion Projection Procedures

    The Department of Environmental Protection hereby gives notice:

    An order was issued on October 6, 2023, denying Thomas Melone’s Petition for a Variance. The Petition was received on January 24, 2023. Notice of receipt of the Petition was published in the Florida Administrative Register on January 27, 2023. The petition requested a variance from rule subparagraphs 62B-33.024(2)(d)3. & 4., F.A.C., which details the procedures to calculate the pre-project shoreline change rate to determine the 30-year erosion projection on a beach with a beach restoration or nourishment project. No public comment was received. The Order, file number 23-0098, denied the variance based on a showing that Petitioner has not demonstrated that requirements for a variance of the rule under section 120.542(2), Florida Statutes, were met.
