SUMMARY: The Department of the Lottery will conduct the Dolphins Fin-tastic Fantasy 5® Football Promotion from October 3, 2011, through December 6, 2011, in which special football prizes will be awarded.

THE FULL TEXT OF THE EMERGENCY RULE IS:

53ER11-54 Dolphins Fin-tastic Fantasy 5® Football Promotion.

(1) Beginning Monday, October 3, 2011, through Tuesday, December 6, 2011, the Florida Lottery will conduct the Dolphins Fin-tastic Fantasy 5® Football Promotion (or “Promotion”). Retailers in the following South Florida counties will be included in the promotion: Collier, Hendry, and Lee in the Lottery’s Fort Myers Sales District; Indian River, Martin, Okeechobee, Palm Beach, and St. Lucie in the West Palm Beach Sales District; and Broward, Miami-Dade, and Monroe in the Miami Sales District. During the promotion period, players who purchase a single $5.00 or more Fantasy 5 ticket at a Florida Lottery (or “Lottery”) retailer location in the counties specified above will receive a voucher with a unique serial number that can be entered in one (1) of five (5) drawings on the Florida Lottery’s website for a chance to win Miami Dolphins (or “Dolphins”) prizes. The purchase price of an EZmatch™ play will not count towards the $5.00 Fantasy 5 purchase requirement. A promotion code will also appear on all qualifying $5.00 or more Fantasy 5 tickets that are produced in conjunction with the Promotion. The promotion code can be used on www.miamidolphins.com for a $5.00 discount on Dolphins game tickets or merchandise.

(2) To enter a voucher serial number in a drawing, players must enter on the Lottery’s website at www.flalottery.com/dolphins or www.flalottery.com. On the home page of the Lottery’s website, players can click on the Dolphins Fin-tastic Fantasy 5 Football Promotion banner and follow the directions. Players can also access the Lottery’s website to enter a voucher serial number via a link located on the Miami Dolphins website at www.miamidolphins.com.

(3) The voucher serial number is located at the bottom on the front of the voucher. Qualifying Fantasy 5 ticket purchases will produce vouchers from the beginning of the promotion period until the close of the Fantasy 5 game at 10:40 p.m. on December 6, 2011. A player will be able to enter his or her voucher serial number beginning at the top of the hour after the Fantasy 5 ticket is purchased. A player entering a voucher serial number prior to the top of the hour after purchase will be directed to return at a later time to enter his or her voucher serial number in the drawing. Fantasy 5 tickets cannot be used for entry in the drawings. Neither the Fantasy 5 tickets purchased in conjunction with this promotion nor the vouchers produced can be cancelled. The odds of winning are dependent upon the number of entries received for each drawing. Vouchers should not be mailed to the Lottery unless players are contacted by the Florida Lottery and requested to do so. Vouchers or tickets received in the mail by the Florida Lottery will not be entered in the drawing and will not be returned.

(4) Five (5) computerized drawings will be held during the period of October 12, 2011, through December 7, 2011, from entries received during the entry periods shown in the table below. Players may enter as many times as they wish during the contest period. However, each valid voucher serial number may only be used one (1) time, for one (1) entry in one (1) drawing. Entries received from the beginning of the entry period for a drawing through midnight ET on the night before the drawing will be included in the drawing. The drawing dates and entry periods are as follows:

In each of the five (5) drawings, two (2) Ford® Fiesta Giveaway Finalists will each win a prize consisting of two (2) tickets to the Dolphins vs. Jets home game at Sun Life Stadium (“Stadium”) on January 1, 2012, and a chance to win a Ford Fiesta or a cash prize of up to $2,500.00, two (2) First Prize winners will each win a “Dolphins VIP for a Day” experiential prize, four (4) Second Prize winners will each win two (2) Dolphins season tickets for the 2012 season, five (5) Third Prize winners will each win a “Dolphins Game Day Experience,” and eighteen (18) Fourth Prize winners will each win two (2) tickets to the Dolphins vs. Jets home game at the Stadium on January 1, 2012.

(5) In each of the five (5) drawings, the first two (2) entries drawn will each win a Ford Fiesta Giveaway Finalist Prize, the third and fourth entries drawn will each win a First Prize, the fifth through the eighth entries drawn will each win a Second Prize, the ninth through the thirteenth entries drawn will each win a Third Prize and the fourteenth through the thirty-first entries drawn will each win a Fourth Prize. An additional ten (10) entries will be drawn in each drawing to serve as alternates, in the order drawn, for unclaimed prizes or mailed prizes returned by the U.S. Postal Service as unclaimed or undeliverable.

(6) The prizewinners in the each of the drawings will be posted on flalottery.com after the drawings. The Florida Lottery will attempt to notify each of the Ford Fiesta Giveaway Finalist and First, Second and Third Prize winners by telephone, U.S. mail, or email using the contact information provided in the winner’s registration data no later than five (5) business days after the winners are drawn. If the Florida Lottery is unable to contact a winner within five (5) business days of the date of the drawing, the winner will forfeit his or her right to claim the prize and the Florida Lottery will award the prize to an alternate winner. As long as a prize remains available, this process will continue until an alternate is contacted or the Florida Lottery has exhausted the list of available alternates. If the Lottery is unable to contact an alternate, the prize will not be awarded.

(7) All entries are subject to validation by the Florida Lottery and may be disqualified if eligibility requirements are not met. To claim a Ford Fiesta Giveaway Finalist, First, Second or Third Prize, a winner must submit for receipt by the Florida Lottery no later than five (5) business days after being notified by the Lottery that he or she is a winner, the original valid voucher bearing the unique serial number selected in the drawing, a completed Winner Claim Form DOL-173-2, revised 02/11, or DOL-173-2S, revised 02/11, a copy of acceptable identification and a completed Release and Authorization form DOL-474, Eff. 10/08, or DOL-474-S, Eff. 9/11. Forms DOL-173-2, DOL-173-2S, DOL-474, and DOL-474-S, are hereby incorporated by reference and can be obtained from any Lottery office or from the Lottery’s website, www.flalottery.com, or by writing to: Florida Lottery, Office of Customer Service, 250 Marriott Drive, Tallahassee, Florida 32399-4016. A winner who cannot produce a valid entry voucher and/or does not submit the required documents to the Lottery as set forth above will forfeit his or her right to claim the prize.

(8) The Lottery will provide the First, Second, and Third Prize winners with a certificate from the Miami Dolphins describing the winner’s prize within ten (10) business days from the date of submission of all required documentation as set forth in subsection (7) above. The certificate will contain the name and contact information for the person the prizewinner is to contact to fulfill the prize or prize package won. The Miami Dolphins shall coordinate with each First and Third Prize winner a mutually agreeable date on which the winner may use the prize package. If an acceptable date during the 2011 season cannot be arranged, a date during the 2012 season shall be selected.

(9) The Lottery will mail the game tickets along with information about the Ford Fiesta Giveaway event to the Ford Fiesta Giveaway finalists’ addresses within approximately ten (10) business days after submission of all required documentation as set forth in subsection (7) above. The Florida Lottery will mail the game tickets to the Fourth Prize winners’ addresses within approximately ten (10) business days after the drawing. If any prize is returned by the U.S. Postal Service as unclaimed or undeliverable, the prize will be awarded to an alternate.

(10) Prizes.

(a) Ford Fiesta Giveaway Finalist Prize. Two (2) upper level (400 level) tickets to the Dolphins vs. Jets home game on January 1, 2012, and the opportunity to win a Ford Fiesta or a cash prize as one (1) of ten (10) finalists in the Ford Fiesta Giveaway described in paragraph (10)(f) below. (Prize value: $105.00 plus the value of either the Ford Fiesta or the cash prize awarded in accordance with paragraph (10)(f) below).

(b) First Prize. One (1) “Dolphins VIP for a Day” prize package. Each prize package consists of a five hundred dollar ($500.00) merchandise credit redeemable at the Dolphins Team Store at the Stadium, two (2) Ford Sideline Club & Lounge passes for a Dolphins game at the Stadium, two (2) executive suite tickets to a Dolphins game at the Stadium, a private tour of the Stadium, meet and greet with a high-level Dolphins official (e.g., Chief Executive Officer or Player Personnel Officer), photograph opportunity on the Stadium playing surface and introduction of the First Prize winner on the Stadium video board during the Dolphins game. (Prize package value: $2,000.00).

(c) Second Prize. Two (2) 2012 Dolphins Season Tickets. Tickets are upper level corner/end zone tickets and are for each Dolphins pre-season and regular season home game at the Stadium during the Dolphins’ 2012 NFL season. (Prize value: $800.00).

(d) Third Prize. One (1) “Dolphins Game Day Experience” prize package. Each prize package consists of two (2) lower level (100 level) tickets to a selected 2011 or 2012 Dolphins home game at the Stadium, two (2) passes to Nat’s BBQ Bash pre-game tailgate at the Stadium prior to the selected Dolphins home game, and one (1) Stadium parking pass for the selected Dolphins home game. (Prize package value: $450.00).

(e) Fourth Prize. Two (2) 400 level tickets to the Dolphins vs. Jets home game on January 1, 2012. (Prize value: $105.00)

(f) Ford Fiesta Giveaway. In the January 1, 2012, Ford Fiesta Giveaway, ten (10) Ford Fiesta Giveaway Finalists attending the Dolphins vs. Jets home game will participate in an in-stadium half-time event in which the winner of one (1) 2012 Ford Fiesta will be determined. Each of the ten (10) finalists will scratch off an oversized symbol to reveal his or her prize of either the 2012 Ford Fiesta or a cash prize. The prizes and number of winners in the Ford Fiesta Giveaway are as follows:

1. The Florida Lottery will pay tax, tag and title fees on the Ford Fiesta as well as applicable federal income tax withholding on the value of the Ford Fiesta prize. The Ford Fiesta prize is valued at approximately $16,500.00, plus tax, tag and title fees. Any additional federal, state and/or local taxes or other fees are the responsibility of the winner.

2. The Dolphins will make the necessary arrangements for the transfer of the Ford Fiesta to the winner.

3. The winner of the Ford Fiesta must be 18 years of age or older.

4. A cash option is not available in lieu of the vehicle.

5. The Florida Lottery provides no warranty for the Ford Fiesta. Any warranties and guarantees are those of the manufacturer only.

(11) If a voucher bearing the serial number selected in the drawing is presented to the Lottery by a person other than the person who entered the number in the drawing, an investigation will be conducted by the Lottery to determine the person entitled to award of the prize.

(12) Except as specifically mentioned herein, all federal, state and/or local taxes or other fees on the Dolphins Fin-tastic Fantasy 5® Football Promotion prizes will be the responsibility of the winner. Federal income taxes are required to be withheld from a prize awarded to a nonresident alien claimant at the rate of thirty percent (30%) pursuant to applicable provisions of the Internal Revenue Code. A nonresident alien claimant who is selected as a winner of a prize for which tax withholding is not paid by the Florida Lottery will be required to pay the withholding tax or forfeit the prize. The reporting and subsequent payment of any additional federal, state and/or local taxes shall be the responsibility of the nonresident alien winner.

(13) No cash option or substitute is available in lieu of the non-cash prizes.

(14) The right to claim a prize cannot be assigned to another person or entity.

(15) All prizes are subject to the provisions of Chapter 24, Florida Statutes, and rules promulgated thereunder. Prizes will be paid in accordance with the rule of the Florida Lottery governing payment of prizes. Copies of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011.

(16) Players must be at least 18 years of age. Persons prohibited by Section 24.116, Florida Statutes, from purchasing a Florida Lottery ticket are not eligible to play.

(17) By entering the Dolphins Fin-tastic Fantasy 5® Football Promotion, a player gives his or her permission for the Florida Lottery to provide the player’s address and telephone number to the Miami Dolphins for prize fulfillment purposes.

(18) A player entering the Dolphins Fin-tastic Fantasy 5® Football Promotion is deemed to have granted permission for the Florida Lottery to photograph and/or videotape and record the prizewinner with or without prior notification and to use the name, photograph, videotape, and/or recording of the prizewinner for advertising or publicity purposes without additional compensation.

(19) The drawings shall be public, held in Tallahassee, Florida, and witnessed by an accountant employed by an independent certified public accounting firm.
