    64B5-2.021Additional Education Requirements for Reexamination

    The Board of Dentistry hereby gives notice:

    of the issuance of an Order regarding the Petition for Variance or Waiver, filed on June 12, 2023, by Anish Reddy, D.D.S. The Notice of Petition for Variance or Waiver was published in Vol. 49, No. 120, of the June 21, 2023, Florida Administrative Register. Petitioner sought a variance from or a waiver of subsection 64B5-2.021(1), F.A.C, which requires any applicant who has failed to pass the clinical examination in three attempts shall not be eligible for reexamination until he or she completes a one year general practice residency, advanced education general dentistry residency, or pedodontic residency or a minimum of one academic year of undergraduate clinical coursework in dentistry at a dental school approved by the American Dental Association’s Commission on Dental Accreditation. The Board considered the instant Petition at a duly noticed public meeting held on August 11, 2023, in Dania Beach, Florida. The Board Order was filed on August 29, 2023. The Board acknowledges that there would be financial costs and potential revenue loss from not being able to practice dentistry. The costs and hardships which Petitioner complains of are not unique to his circumstances. Accordingly, the Board finds that the Petitioner has failed to demonstrate a substantial hardship or violation of principles of fairness as contemplated by Section 120.542, F.S., and hereby denies Petitioner a waiver of Rule 64B5-2.021, F.S.
