SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board concluded that this rule change will not have any impact on licensees and their businesses or the businesses that employ them. The rule will not increase any fees, business costs, personnel costs, will not decrease profit opportunities, and will not require any specialized knowledge to comply. This change will not increase any direct or indirect regulatory costs. Hence, the Board determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

THE FULL TEXT OF THE PROPOSED RULE IS:
64B7-25.001 Examination Requirements.
(1) The Department shall issue a license by examination to a person who:
(a) No Change.
(b) Submits a completed application on form DH-MQA 1115, “Application for Massage Therapist License,” (07/202205/2020). The form and the attached instructions areis incorporated herein by reference and may be obtained from the bBoard oOffice at 4052 Bald Cypress Way, Bin C-06, Tallahassee, Florida 32399 or from the website located at http://floridasmassagetherapy.gov/applications/massage-app.pdf or http://www.flrules.org/Gateway/reference.asp?No=Ref- 12647. (c) Provides proof of graduation per Rule 64B7-32.002, F.A.C., from a bBoard-approved massage therapy school as defined in Section 480.033(9),. F.S.;
(d) through (e) No Change.
(2) Prior to the practice of colonic irrigation, any licensed massage therapist must be certified. The Department shall issue certification to practice colonic irrigation to a person who:
(a) No Change.
(b) Submits a completed application on form DH-MQA 1247, “Application for Colonic Irrigation Certification” (07/2022Rev. 05/2020). The form is incorporated herein by reference and may be obtained from the Board Office at 4052 Bald Cypress Way, Bin C-06, Tallahassee, Florida 32399 or from the website located at http://floridasmassagetherapy.gov/applications/massage-colon-certification.pdf or http://www.flrules.org/Gateway/reference.asp?No=Ref- 12648. (c) Provides proof of completion of a training program in colonic irrigation at a bBoard-approved massage therapy school pursuant to per Rule 64B7-32.005, F.A.C., or a training program equal to or more stringent than the colonic irrigation requirements of Rule subsection 64B7-32.005(2), F.A.C., with an approved provider or school in another state, territory, or jurisdiction, or a colonic irrigation apprenticeship per Rule 64B7-29.007, F.A.C.; and,
(d) Presents certification to the bBoard of successful completion of an approved examination for colonic irrigation.
(3) The bBoard approves the following examinations for licensure:
(a) through (e) No Change.
(4) No Change.
