    The Department of Environmental Protection hereby gives notice: That it has issued an order on October 19, 2023 granting Randal D. Bellestri’s Petition for a Variance. The Petition was received on July 27, 2023. Notice of receipt of this Petition was published in the Florida Administrative Register on August 1, 2023. The petition requested a variance from the rule provisions of subsections 62B-33.002(12)(b)1., 62B-33.002(39), and subparagraph 62B-33.0051(1)(a)1., F.A.C., which requires that in order to qualify for a permit for coastal armoring, the structure proposed to be protected must be an eligible structure. No public comment was received. The Order, OGC file number 23-1207, granted the Petition based on a demonstration by the Petitioner that the purpose of the underlying statute is met and that a strict application of the rule would result in substantial hardship to Petitioner and would affect Petitioner differently than other similarly situated applicants.
