    PURPOSE AND EFFECT: The proposed rulemaking will conform rules with recent amendments to Chapter 440, Florida Statutes. The rulemaking addresses the number of days an employer has to comply with a written request from the Department to produce required business records, amends the calculation of any applicable penalty and penalty credits, and creates a workers’ compensation coverage and compliance tutorial that allows an additional 15 percent penalty reduction for successfully completing the tutorial. The rulemaking also updates forms and makes other necessary updates.

    SUBJECT AREA TO BE ADDRESSED: Department powers to enforce employer compliance with workers’ compensation insurance coverage requirements, penalty calculation for noncompliance, and calculation of credits and penalty reductions.
