6A-2.0040Sanitation Standards in K-12 Private Schools

The Department of Education hereby gives notice: that on July 3, 2024, the Department of Education, received a Petition for Variance from paragraph 6A-2.0040(7)(b), F.A.C., Sanitation Standards in K-12 Private Schools. The petition, dated July 3, 2024, and supplemented on July 11, 2024, requests a variance or waiver exempting the school from the requirement for one particular type of water fountain for each 100 students as prescribed by rule. The petitioner is Broward Career Preparation School, located in Southwest Ranches, Florida.

Notice of the petition was published in Vol. 50, No. 133, F.A.R., on July 9, 2024. Having received no public comment on the petition, the order on this petition was executed on October 8, 2024. After a complete review of the petition, the Department finds that the rule, as applied, will create a financial hardship for Petitioner. The Department further finds that Petitioner’s proposed alternative scheme would adequately address the concerns and purpose set forth by the rule’s underlying statutes. Petitioner shall strictly adhere to the operating procedures outlined and adopted by the order, and shall maintain a copy at its location during all periods of operation.
