    The Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on February 3, 2017, by Christin Verna. The Notice of Petition for Waiver or Variance was published in Volume 43, Number 24, of the February 6, 2017, Florida Administrative Register. The Petitioner was seeking a waiver or variance of paragraph 64B4-21.007(1)(b), and (c), F.A.C., entitled, “Definition of a Licensed Marriage and Family Therapist with at Least Five Years Experience or the Equivalent, Who Is a Qualified Supervisor," which states that a licensed marriage and family therapist, who is a qualified supervisor, as used in paragraph 491.005(3)(c), F.S., is defined as an individual who, during the period for which the applicant claims supervision meets one of the following: (a) Holds an active license as a marriage and family therapist in the state of Florida; (b) Is licensed or certified as a marriage and family therapist in another state, or resides in a state in which licensure for marriage and family therapy is not required, and can document a minimum of six (6) semester or eight (8) quarter hours of graduate coursework in marriage and family systemic theories and techniques, and five (5) years of clinical experience as a marriage and family therapist.

    The Board considered the instant Petition at a duly-noticed meeting, held February 9, 2017, in Jacksonville, Florida. The Board’s Order, filed on March 22, 2017, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute would be met by granting a variance or waiver from Rule 64B4-21.007, F.A.C. The Board further finds that Petitioner failed to establish that applying the requirements of the aforementioned rule to her circumstances would violate principles of fairness and impose substantial hardship.
