The Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on August 3, 2017, by Patrick R. Yewell. The Notice of Petition for Waiver or Variance was published in Volume 43, Number 170, of the August 31, 2017, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rule 64B4-2.001, F.A.C., entitled “Definition of ‘Experience’ for Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling,” which states that two year(s) of “clinical experience,” for clinical social work, marriage and family therapy or mental health counseling as used in Section 491.005, F.S., consists of at least 1500 hours of providing psychotherapy face-to-face with clients as a registered intern for the profession for which licensure is sought; and, shall be accrued in no less than 100 weeks. Petitioner also sought a waiver or variance of paragraph 64B4-2.002(1)(a), F.A.C., entitled, “Definition of ‘Supervision’ for Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling,” which states that an intern shall be credited for the time of supervision required by Section 491.005, F.S., if the intern received at least 100 hours of supervision in no less than 100 weeks.
The Board considered the instant Petition at a duly-noticed meeting, held August 10, 2017, in Tampa, Florida. The Board’s Order, filed on November 8, 2017, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from Rules 64B4-2.001 and 64B4-2.002, F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
