The Department of Management Services, Emergency Communications Board hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver for Pinellas County, filed on October 3, 2023. The Notice of Petition for Variance or Waiver was published in Volume 49, No. 193, of the October 4, 2023, Florida Administrative Register. The Petitioner sought a variance or waiver of paragraph 60FF1-5.013(4)(a), F.A.C., entitled “Call Handling System Maintenance” regarding reimbursement for maintenance costs of call handling systems (CHS), which states, to participate in this program, each medium and large county must submit its documented CHS maintenance cost for one system for the fiscal year beginning October 1 and ending September 30 by January 1 of the following year. The Board considered the Petition at a duly-noticed teleconference meeting held on October 18, 2023. The Board’s Order, filed on November 6, 2023, grants the Petition for variance or waiver, finding that Petitioner has complied with the requirements of subsection 120.542(2) of the Florida Statutes. Specifically, Petitioner has demonstrated how the purpose of the underlying statute, 365.172(6)(a)3., F.S., would be achieved. Additionally, Petitioner has demonstrated that failure of the Emergency Communications Board to grant Pinellas County’s petition would cause a substantial hardship for petitioner. Based upon the foregoing, the Board determined that Petitioner is eligible for a variance or waiver of paragraph 60FF1-5.013(4)(a), F.A.C.
