The Department of Management Services, E911 Board hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Hendry County, filed on October 27, 2015. The Notice of Petition for Variance or Waiver was published in Volume 41, No. 214, of the November 3, 2015, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on November 18, 2015. The Petitioner was requesting a Variance or Waiver of paragraph 60FF-5.002(3)(a), F.A.C., regarding the requirement that the E911 Board Form 6A must be provided with applicant’s “W Form 1A” application and be postmarked or delivered on or before October 1.

The Board's Order, filed on December 2, 2015, grants the Petition for Variance or Waiver, finding that Petitioner has complied with the requirements of Section 120.542(2) of the Florida Statutes. Specifically, Petitioner has demonstrated how the purpose of the underlying statute would be achieved by submission of the E911 Form 6A. Additionally, Petitioner has demonstrated that failure of the E911 Board to consider Hendry County’s grants application would cause a substantial hardship for Hendry Country. Based upon the foregoing, the Board determined that Petitioner is eligible for a waiver or variance of paragraph 60FF-5.002(3)(a), F.A.C.
