    PURPOSE AND EFFECT: The Agency is proposing to amend Rule 59A-11.003, F.A.C., Licensure Procedures, to update incorporated application forms, remove obsolete language, and add sunset language.

    SUMMARY: The proposed changes in Rule 59A-11.003, F.A.C., will update the incorporated application form, AHCA Form 3130-3001, strike specific licensing fee amount from rule, and remove obsolete language.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: A SERC has not been prepared by the agency. For rules listed where no SERC was prepared, the Agency prepared a checklist for each rule to determine the necessity for a SERC. Based on this information at the time of the analysis and pursuant to section 120.541, Florida Statutes, the rule will not require legislative ratification.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    59A-11.003 Licensure Procedures.

    (1) An applicant or licensee requesting licensure for the operation of a birth center under the provision of Chapter 383, F.S., shall make application to the Agency on the Health Care Licensing Application, Birth Center, AHCA Form 3130-3001, January 2022 June 2018, which is incorporated by reference, and available at https://www.flrules.org/Gateway/reference.asp?No=Ref-XXXX. Applicants for renewal and change during licensure period may submit the Health Care Licensing Online Application, Birth Center, AHCA Form 3130-3001OL, January 2022 June 2018, incorporated by reference and available at https://www.flrules.org/Gateway/reference.asp?No=Ref-XXXX. The application forms are also available at http://www.ahca.myflorida.com/HQAlicensureforms or, for online submissions, at: http://apps.ahca.myflorida.com/SingleSignOnPortal.

    (2) Each birth center applying for a license shall be designated by a distinctive name. Duplication of an existing birth center’s name is prohibited in new birth centers.

    (3) An application for a change of ownership shall include a signed agreement with the Agency to correct deficiencies listed in the most recent licensure and life safety inspections.

    (4) A licensure fee of $392.80 per birth center shall accompany the application for an initial, renewal or change of ownership license.

    (3) This rule is in effect for five years from its effective date.
