    PURPOSE AND EFFECT: The purpose and effect of the proposed amendments are to repeal rules identified during the Department's comprehensive rule review as duplicative of statute or no longer necessary.

    SUMMARY: Rule 64B-1.001, F.A.C., addresses application deadlines and the rescheduling of examinations by applicants. Rule 64B-1.002, F.A.C., addresses the notification of applicants by the Department regarding examination date, time and location. Rule 64B-1.003, F.A.C., provides procedures for the administration of exams. Rule 64B-1.004, F.A.C., addresses the conduct of exam administrators, proctors and applicants. Rule 64B-1.006, F.A.C., provides procedures for the administration of practical or clinical examinations. Rule 64B-1.007, F.A.C., outlines the criteria by which examiners are selected.

    Rule 64B-1.009, F.A.C., addresses the pre-hearing review pursuant to Rule 28-106.209, F.A.C. Rule 64B-1.012, F.A.C., provides guidelines for sharing department developed examinations and items with other state licensing authorities.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the SERC checklist does not indicate that the statutory threshold for ratification will be exceeded.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
