62-610.421Setback Distances
The Department of Environmental Protection hereby gives notice: that a Final Order was issued on February 7, 2019, granting Lake Toho RV Resort, LLC’s Petition for a Variance. The Petition was received on December 18, 2018. Notice of receipt of this Petition was published in the Florida Administrative Register on January 11, 2019. The petition requested a variance to allow a 25’ setback to the property line in subsection 62-610.421(2), F.A.C., which states the permittee shall maintain a setback distances of 100 feet between the wetted site area subject to land application and the site property line. No public comments were received. The Order, File No. FLA010965-008; OGC Case No. 19-0036, granted the Petition to subsection 62-610.421(2), F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner and because Petitioner demonstrated that the purpose of the underlying statute will be achieved by other means.
