    PURPOSE AND EFFECT: The proposed rule amendments are intended to update the rule language for documentation for licensure.

    SUMMARY: To update the rule language.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    64B3-6.002 Documentation for Licensure.

    The following is a list of acceptable documents which shall be submitted to the Board as appropriate for the type of license sought to show eligibility for the license:

    (1) through (6) No change.

    (7) Applicants Individuals with a baccalaureate degree in accredited medical technology programs from accredited institutions in the Philippines need only submit official transcripts sent directly by the institution to the Board office. No foreign credentials evaluation is necessary.

    (8) Applicants with a degree from an regionally accredited U.S. college or university recognized by the United States Department of Education, or foreign equivalent, whose major is not a chemical or biological science, who otherwise meet the requirements for the license sought pursuant to Chapter 64B3-5, F.A.C., may submit their academic credentials for a determination by the Board that their degree is equivalent to a degree in clinical laboratory, chemical or biological science. 

    (a) Such determination shall be made by the Board based upon actual degree earned, the number and type of academic science credits earned, and the courses taken. Applicants without the requisite number of academic science credits cannot be determined to have equivalent degrees for the purposes of licensure.

    (b) The applicant may be requested by the Board to submit an additional evaluation of the applicant’s academic record from the chairperson of a chemical or biological science department of an regionally accredited U.S. college or university recognized by the United States Department of Education to demonstrate that the applicant’s education is equivalent to a U.S. degree in the chemical or biological sciences which shall be reviewed by the Board in conjunction with the Applicant’s academic credentials.
