The Department of Environmental Protection hereby gives notice that it has issued an order on November 10, 2014 granting Orange County Environmental, L.L.C.’s Petition for a Waiver. The Petition was received on October 8, 2014. Notice of receipt of this Petition was published in the Florida Administrative Register on October 10, 2014. The petition requested a waiver from paragraphs 62-701.630(3)(a) and 62-701.630(3)(b), F.A.C., to allow the Petitioner to provide closing cost estimates based on the use of on-site soils rather than the cost of cover soils. No public comment was received. The Order, file number 14-0562, granted the Petition to paragraphs 62-701.630(3)(a) and 62-701.630(3)(b), F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
