    PURPOSE AND EFFECT: This rule implements s. 381.986(8)(b), Florida Statutes, by establishing a supplemental licensure fee sufficient to cover the costs of administering ss. 381.989 and 1004.4351, Florida Statutes.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has been prepared by the Agency.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    64-4.025 Medical Marijuana Treatment Center Supplemental Licensing Fee.

    (1) A “Supplemental Licensing Fee” is the annual payment by a registered medical marijuana treatment center to cover the costs of administering sections 398.989 and 1004.4351, F.S. The supplemental licensing fee for each medical marijuana treatment center is $174,844.08. 

    (2) The initial supplemental licensing fee is due within 45 days of the effective date of this rule. All subsequent payment for the supplemental licensing fee shall be due on or before July first annually.

    (3) Failure to submit the supplemental licensing fee by July first shall result in the suspension of the medical marijuana treatment center license until the fee is paid in full.
