    NOTICE IS HEREBY GIVEN that the Board of Chiropractic Medicine has issued an order disposing of the petition for declaratory statement filed by David Otto, D.C. on December 5, 2014. The following is a summary of the agency’s disposition of the petition:

    The Notice of Petition for Declaratory Statement was published on December 31, 2014, in Vol. 40, No. 251, of the Florida Administrative Register. Petitioner sought the Board’s interpretation of Section 460.403, Florida Statutes, and Rule 64B2-15.001, F.A.C., regarding questions outlined in the petition concerning the definition of expert and whether petitioner has the ability to advertise as a nutrition expert; and/or Functional Medicine Clinic/Natural Medicine Clinic. In addition Petitioner requests a list of words approved for advertising for chiropractic services. The Board of Chiropractic Medicine considered the Petition at its meeting held on January 9, 2015, in Orlando, Florida. The Boards Order filed on January 27, 2015, declined to answer the petition, stating that the statute and rules are clear on their face.
