PURPOSE AND EFFECT: The purpose of the proposed rule amendments is to incorporate the most recent edition of the National Electrical Safety Code. As Rule 25-4.036, F.A.C., is incorporated by reference into Rules 25-24.585, 25-24.740 and 25-24.835, F.A.C., the draft amendments to Rule 25-4.036, F.A.C., also effect shared tenant service companies, alternative access vendor service companies, and competitive local exchange companies. SUBJECT AREA TO BE ADDRESSED: National Electric Safety Code standards pertaining to the design and construction of telecommunications facilities by incumbent local exchange companies, shared tenant service companies, alternative access vendor service companies, and competitive local exchange companies.

THE PRELIMINARY TEXT OF THE PROPOSED RULE DEVELOPMENT IS:

25-4.036 Design and Construction of Plant.

(1) The plant and facilities of the utility shall be designed, constructed, installed, maintained and operated in accordance with provisions of the National Electrical Safety Code (IEEE C2-20072002) and the National Electrical Code (NFPA 70-2005), which is incorporated herein by reference, pertaining to the construction of telecommunications facilities.
