    NOTICE IS HEREBY GIVEN that the Board of Pharmacy has issued an order disposing of the petition for declaratory statement filed by Susan Trujillo, Esquire, on behalf of PharMerica AscribeRx America LLC. on January 08, 2019. The following is a summary of the agency's disposition of the petition: The Notice of Petition for Declaratory Statement was published in Volume 45, No. 07, of the January 10, 2019, Florida Administrative Register. The Petitioner sought a Declaratory Statement from the Board asking for the agency’s opinion as to the applicability of paragraph 64B16-28.607(2)(a), F.A.C., and Section 465.0235, F.S., seeking clarification on whether “automated pharmacy systems” may be placed in Assisted Living Facilities (ALFs). The Board of Pharmacy considered the Petition at a duly-noticed public meeting held on February 6, 2019, in Tallahassee, Florida. After discussion regarding the merits of the Petition and the Board’s decision to initiate rulemaking to amend the rule at issue, Petitioner moved to withdraw the Petition for Declaratory Statement. The Board’s Order, filed on March 6, 2019, granted the request for withdrawal of the Petition for Declaratory Statement.
