The Board of Professional Engineers hereby gives notice:

The Board of Professional Engineers hereby gives notice of the issuance of an Order Granting Petition for Variance or Waiver, of Rule 61G15-21.004, F.A.C., filed on July 16, 2012, by John D. Rice. The Notice of Petition for Variance or Waiver was published in Vol. 38, No. 31, of the August 3, 2012 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting on August 9, 2012. The Petitioner sought a waiver of the provision of Rule 61G15-21.004, F.A.C. with respect to the required passing grade for the Principles and Practice Examination, and requested that the Board endorse his Professional Engineering License from the state of Georgia.

The Board found that the Petition was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. The Board further found that the applicant met the purpose of the underlying statute by other means and otherwise showed that a strict application of the rule would violate principles of fairness. The Board approved the Petition for Waiver or Variance of Rule 61G15-21.004, F.A.C., and further granted the Petitioner’s application for licensure. The Board filed its final order on September 11, 2012.
