    SUMMARY: This emergency rule describes the on-line game “LUCKY 7 RAFFLE™,” for which the Department of the Lottery will sell tickets beginning March 21, 2011.

    THE FULL TEXT OF THE EMERGENCY RULE IS:

    53ER11-17 LUCKY 7 RAFFLE™

    (1) LUCKY 7 RAFFLE™ is a number-match game with a limited number of tickets available that will be sold within a limited sales period.

    (2) Each LUCKY 7 RAFFLE ticket costs $10.

    (3) LUCKY 7 RAFFLE tickets will go on sale Monday, March 21, 2011. Sales of LUCKY 7 RAFFLE tickets will cease immediately after the 1,000,000th ticket is sold or at midnight on May 4, 2011, whichever occurs first. With the first 100,000 LUCKY 7 RAFFLE tickets sold, a free FLORIDA LOTTO™ Quick Pick ticket for the next available draw will print automatically. A message will print on the player’s LUCKY 7 RAFFLE ticket to alert players of their free ticket.

    (4) Each LUCKY 7 RAFFLE ticket will contain a unique ticket number that will be automatically entered in the LUCKY 7 RAFFLE drawing on May 5, 2011. The overall odds of winning a prize in the LUCKY 7 RAFFLE drawing are 1 in 1,276 if all 1,000,000 tickets are sold.

    (5) LUCKY 7 RAFFLE tickets will automatically print from the terminal with ticket numbers issued in sequential order from 0000001 to 1000000 as they are sold throughout the state. Each LUCKY 7 RAFFLE ticket will contain only one ticket number. Players cannot select their own ticket numbers.

    (6) LUCKY 7 RAFFLE tickets cannot be cancelled.

    (7) A random computerized drawing from among all LUCKY 7 RAFFLE ticket numbers issued during the sales period will be held on May 5, 2011. A total of 784 prizes will be awarded. Prizes will be awarded in the order drawn. The first through 7th numbers drawn will win the top prize of $700,000 cash. The 8th through 14th numbers drawn will win $70,000, and will be alternates in the order drawn, for a $700,000 prize in the event a top prize is not claimed within the 180-day claim period. The 15th through 84th numbers drawn will win $700, and the 85th through the 784th numbers drawn will win $70.

    (8) The LUCKY 7 RAFFLE drawing will be held on May 5, 2011, and shall be public and witnessed by an accountant employed by an independent certified public accounting firm. Winning numbers will be available after the drawing on the Florida Lottery’s Web site at flalottery.com, by phone at (850)921-7529, or at a Lottery retailer.

    (9) Winning LUCKY 7 RAFFLE tickets of $70 can be claimed at a Lottery retailer. Winning LUCKY 7 RAFFLE tickets of $700 and $70,000 must be presented to a Florida Lottery office for payment. Tickets winning $700,000 must be claimed at Lottery headquarters. Information about procedures for filing a claim can be obtained at flalottery.com or by calling (850)487-7787 (TDD (850)487-7784). LUCKY 7 RAFFLE tickets are the only valid receipts to redeem a prize.

    (10) LUCKY 7 RAFFLE prizes must be claimed within 180 days from the date of the drawing (November 1, 2011).

    (11) If a winning LUCKY 7 RAFFLE ticket bearing any of the first seven (7) winning numbers is not presented to a Florida Lottery office for payment within 180 days from the date of the drawing, the 8th through 14th prizewinners who have claimed their prize within the 180-day claim period will be used in the order in which they were drawn to select alternate winners for the $700,000 top prize. The alternate winner will be awarded the difference between the $70,000 prize and the $700,000 prize.

    If applicable, the Florida Lottery will attempt to notify, for a period of two (2) weeks, the first alternate drawn in the $70,000 prize category, who will be awarded the higher prize. If the Florida Lottery is unable to contact the first alternate, the Florida Lottery will attempt to notify, for a period of two (2) weeks, the second alternate drawn. This process will continue until an alternate is contacted or the Florida Lottery has exhausted the list of available alternates, in which case the $700,000 prize will not be awarded.

    (12) Players must be at least 18 years of age. Persons prohibited by Section 24.116, F.S., from purchasing a Florida Lottery ticket are not eligible to play.

    (13) All LUCKY 7 RAFFLE prizes are subject to the provisions of Chapter 24, Florida Statutes, and rules promulgated thereunder, including the official LUCKY 7 RAFFLE rule. Prizes will be paid in accordance with the rule of the Florida Lottery governing payment of prizes. Copies of the current prize payment rule and the LUCKY 7 RAFFLE rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011.

    (14) Payment of all federal, state and/or local taxes will be the responsibility of the winner. Federal withholding taxes will be deducted from the $700,000 and $70,000 cash payments.
