In accordance with subsection 120.74(5), F.S., the Department extends the April 1 deadline to publish Notice of Proposed Rule for Chapter 62-6, F.A.C., entitled Standards for Onsite Sewage Treatment and Disposal Systems (OSTDS). Amendments to the rule define authority for private provider inspectors to inspect an OSTDS when qualified as a private provider inspector and upon written authorization by the owner of the system. An initial Notice of Rule Development for Rules 62-6.002, 62-6.003, 62-6.027 and 62-6.030, F.A.C., was published in the Florida Administrative Register on July 1, 2022, Vol. 48/128. A second Notice of Rule Development for Rules 62-6.001 and 62-6.024, F.A.C., was published in the Florida Administrative Register on November 18, 2022, Vol. 48/225. These amendments will update regulatory requirements and definitions, and create a new Rule 62-6.024, F.A.C., relating to enforcement and auditing of private provider inspections as directed by Chapter 2022-105, Laws of Florida. Two public Rule Development workshops were held: July 19, 2022, and December 6, 2022. The Department is evaluating public comments received regarding the draft rule language and considering any necessary changes based on public input.
