PURPOSE AND EFFECT: To update the application to register a dental laboratory and to change the dental laboratory inspection schedule from annual to biennial as required by recently enacted legislation.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: Based on the SERC checklist, this rulemaking will not have an adverse impact or regulatory costs in excess of $1 million within five years as established in s.120.541(2)(a), F.S.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

64B27-1.001 Dental Laboratory Inspections, and Practice and Procedure for Healthy and Safe Dental Laboratory Operation.

(1) Each dental laboratory registered by the Department of Health to operate in the State of Florida shall be subject to periodic inspections by Department personnel at least one time during the calendar year once each biennial registration period. Such inspections shall be conducted during regular business hours and may occur with or without notice.

(2) through (4) No change.

64B27-1.002 Dental Laboratory Biennial Registration.

The Department shall issue a registration certificate entitling the holder to operate a dental laboratory for a period of two years, after the Department has received from the registering person, firm, or corporation:

(2) through (3) No change.
