The Board of Massage Therapy hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on October 5, 2018, by Trudy Hunter, Owner of Personal Wellness DBA Massage Green Spa. The Notice of Petition for Waiver or Variance was published in Vol. 44, No. 202, of the October 16, 2018, Florida Administrative Register. Petitioner sought a waiver of paragraph 64B7-26.003(1)(d), F.A.C., as it relates to the use of Infrared Saunas/Cabins in massage therapy establishments. The Board considered the instant Petition at a duly-noticed public meeting held on December 12, 2018, by telephone conference call. The Board’s Order, filed on March 15, 2019, 2014, found that Petitioner has achieved the purpose of the underlying statute by other means, and has demonstrated compliance with the rule would pose a substantial hardship on Petitioner. The Board finds the petition or variance and waiver should be granted.
