PURPOSE AND EFFECT: The District proposes to amend its rules in accordance with the biennial review contemplated by Section 120.74(1), Fla. Stat. The proposed amendments provide clarity from Consumptive Use Permitting Consistency amendments.

SUBJECT AREA TO BE ADDRESSED: Rule 40E-2.061 is amended to include equivalent NAVD; Rule 40E-2.071 is corrected to include any connected canal systems that derive water supply from Canals C-23, C-24 or C-25, which is consistent with the Applicant’s Handbook for Water Use Permits; Rule 40E-2.091 is amended to include incorporation of certain sections of the Environmental Resource Permit Applicant’s Handbook Volume I: General and Environmental, and to update and correct criteria following the recent adoption of broad rule amendments for the statewide Consumptive Use Permitting Consistency effort.
