SUMMARY: This rule sets forth the EZmatch™ Retailer Bonus Sales Commission program that will be conducted between April 27, 2015, and May 17, 2015.

THE FULL TEXT OF THE EMERGENCY RULE IS:

 

53ER15-26 EZmatch™ Retailer Bonus Sales Commission.

(1) Beginning April 27, 2015, through May 17, 2015, the Florida Lottery will conduct, as a retailer sales incentive, the EZmatch™ Retailer Bonus Sales Commission program in which the Florida Lottery will double the retailer sales commissions for EZmatch sales on FANTASY 5® and LUCKY MONEY™.

(2) The Florida Lottery will pay retailers a 5% bonus sales commission on EZmatch for each FANTASY 5 with EZmatch sale and each LUCKY MONEY with EZmatch sale in addition to the standard commission set forth in Rule 53ER13-46, Florida Administrative Code, for a total of $.15 for each $2.00 FANTASY 5 with EZmatch sale and $.15 for each $2.00 LUCKY MONEY with EZmatch sale.

(3) The bonus sales commission will be reflected on the retailer’s weekly Settlement Report at the conclusion of the incentive.

(4) Retailers whose Florida Lottery contracts are terminated or inactivated prior to payment of the bonus sales commissions shall be paid the commissions earned provided said termination or inactivation was not due to noncompliance with Chapter 24, Florida Statutes, Chapter 53, Florida Administrative Code, or terms of the retailer contract.

(5) Bonus sales commissions will be considered compensation to retailers for Internal Revenue Service purposes. The Florida Lottery reserves the right to apply a bonus sales commission earned against a retailer’s outstanding debt to the Florida Lottery.
