    The State of Florida Department of Environmental Protection hereby gives notice that a Final Order granting a variance from Subsection 62S-2.075(2), Florida Administrative Code, was issued on April 2, 2013. The petition was received on January 2, 2013, from the State of Florida Department of Agriculture and Consumer Services requesting a variance from Subsection 62S-2.075(2), Florida Administrative Code, which requires that an applicant for grant funds under the Recreational Trails Program receive the State of Florida Department of Environmental Protection's formal approval of commencement documentation prior to the commencement of construction of an approved project. Notice of receipt of the petition was published in the Florida Administrative Register on January 11, 2013. Public comment was received and reviewed. The Final Order (OGC No. 13-0007, OGC Final Order No. 13-0794) granted the petition based on the petitioner showing that the strict application of the rule would result in substantial hardship to the petitioner due to the loss of grant funding for the trail improvements that were constructed and because the underlying statute, which is development and improvement of recreational trails and trail-related facilities on publicly-owned lands to provide access to healthful outdoor recreational opportunities for the public, has been achieved by the petitioner by other means.
