A Notice of Rule Development for the above referenced rules was published in the Vol. 42, No. 237, December 8, 2016 issue of the Florida Administrative Register wherein the Department proposed to adopt rules to implement Section 403.067(7)(d)2.c., F.S., which was created by the 2016 Florida Legislature. The statute required the Department to initiate rulemaking by January 1, 2017. These rules were listed in the Department’s Proposed Regulatory Plan as 5M-1.021 and 5M-1.022. A rule workshop was held on February 3, 2017, and the Department is currently awaiting a second round of comments from interested parties to determine if further workshops will be required. Therefore, the Department will exercise the extension provided by Section 120.74(5), F.S, and will not publish the Notice of Proposed Rule for the above referenced rules. The Department expects to publish the Notice of Proposed Rule before June 30, 2017.
