    PURPOSE AND EFFECT: The purpose of the rule amendment is to incorporate updated, more comprehensive material and prohibited drugs and substances list from World Anti-Doping Agency.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Commission meeting, the Commission, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    61K1-3.017 Drugs and Foreign Substances; Penalties.

    (1) For purposes of Section 548.046, F.S., Prohibited Substances shall include all substances set forth by the World Anti-Doping Agency (WADA) World Anti-Doping Code International Standard Prohibited List, effective January 1, 2019, incorporated herein by reference, http://www.flrules.org/Gateway/reference.asp?No=Ref-0XXXX. The presence of a prohibited substance in a urine sample is not a violation if the quantity of the prohibited substance does not exceed the threshold established in Decision Limits for the Confirmatory Quantification of Threshold Substances, WADA Technical Document TD2019DL, effective March 1, 2019, published by the World Anti-Doping Agency, incorporated herein by reference, http://www.flrules.org/Gateway/reference.asp?No=Ref-0XXXX. The materials incorporated by reference herein can be obtained at www.myfloridalicense.com or by contacting the Department of Business and Professional Regulation, Florida State Boxing Commission, 2601 Blair Stone Road, Tallahassee, Florida 32399-1016.:

    (a) Caffeine;

    (b) Beta 2 Agonist – provided it is selected from the following list and is in aerosol or inhalant form only:

    (10) Anti-estrogenic agents;

    (11) Cocaine;

    (12) LSD;

    (13) Opiates (eg. Heroin, Codeine, and Morphine);

    (14) MDMA (Ecstacy);

    (15) GHB;

    (16) PCP (Phencyclidine);

    (17) Human Growth Hormones;

    (18) Mechano growth factors;

    (19) Gonadtropines, including but not limited to hCG and LH;

    (20) Erythropoiesis-stimulating agents;

    (21) Corticotrophines;

    (22) Hormone Antagonists and Modulators; except as otherwise authorized by rule herein:

    Those Used Externally or Designed for External Use:

    (2) The following drugs or foreign substances may be used by participants under the conditions described herein:

    (a) Petroleum Jelly – The discretional use of petroleum jelly shall be allowed around the eyes. However, the use of petroleum jelly on the arms, legs and body of a participant is prohibited.

    (b) The discretional use of Thrombin or a 1/1000 solution of Adrenalin and Avitene Avitine, or their generic equivalents, as approved by the physician, shall be allowed between rounds to stop bleeding of minor cuts and lacerations sustained by a participant.
