    64B7-32.003Minimum Requirements for Board Approved Massage Schools

    The Board of Massage Therapy hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on February 20, 2020 by Emma Jean Brown. The Notice of Petition for Waiver or Variance was published in Vol. 46, No. 40, of the February 27, 2020 Florida Administrative Register. Petitioner sought a waiver of Rule 64B7-32.003, F.A.C., regarding minimum requirements for board approved massage school. The Board considered the instant Petition at a duly-notice telephonic meeting held on April 3, 2020, in Tallahassee, Florida. The Board’s Order, filed on April 28, 2020, denied the petition stating that the correspondence does make reference to paragraph 64B7-32.003(1)(c) F.AC., but does not include facts which show that the purpose of the underlying statute will be or has been achieved by other means by the person and when application of a rule would create a substantial hardship or would violate the principles of fairness… as required by subsection 120.542(2), F.S.
