The Emergency Communications Board hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver for St. Johns County, filed on January 11, 2024. The Notice of Petition for Variance or Waiver was published in Volume 50, No. 10, of the January 16, 2024, Florida Administrative Register. The Petitioner sought a variance or waiver of a provision in the application form titled “911 Grant Programs, Form W Form 3A,” incorporated into paragraph 60FF1-5.003(2)(a), Florida Administrative Code. The Board considered the Petition at a duly-noticed teleconference meeting held on January 23 and 24, 2024. The Board’s Order, filed on February 20, 2024, grants the Petition for variance or waiver, finding that Petitioner has complied with the requirements of subsection 120.542(2) of the Florida Statutes. Specifically, Petitioner has demonstrated how the purpose of the underlying statute, 365.172(6)(a)3.b., F.S., would be achieved. Additionally, Petitioner has demonstrated that failure of the Emergency Communications Board to grant St. Johns Countys’ petition would cause a substantial hardship for petitioner. Based upon the foregoing, the Board determined that Petitioner is eligible for a variance or waiver of Rule 60FF1-5.003, F.A.C.
