64E-28.006: Education Course Requirements
The Department of Health hereby gives notice: that on May 14, 2013, the Department of Health filed an Order disposing of a petition for variance from the requirements of paragraph 64E-28.006(3)(b), F.A.C., which requires internet-based tattoo education courses to incorporate a means of identity verification and validation using technology that seeks verification through internet databases using information that is specific to the student’s identity, and paragraph 64E-28.006(3)(c), F.A.C., which requires the automatic termination of this course when the student fails to answer an identity validation question during a 60 second response time or the student provides more than one incorrect answer. The petition filed by Jeff Godin, on behalf of ICE Training Institute, was filed with the Department on January 28, 2013, and noticed in the F.A.R. on February 8, 2013, in Vol.39, No. 27. The Department determined that the Petitioner was able to demonstrate that the underlying statute will have been achieved or has been achieved by other means and that application of the rules would violate the principals of fairness. Therefore, the petition for permanent variance is granted.
