    NOTICE IS HEREBY GIVEN that on April 20, 2018, the Department of Health, received a petition for variance from Rita Palmer, representing Papa Johns. Specifically, the petitioner seeks a variance from subsections 64E-11.002(36) and 64E-11.004(2), Florida Administrative Code, which defines potentially hazardous food and states perishable food shall be stored at such temperatures as will protect against spoilage. All potentially hazardous food shall be kept at safe temperatures, 41 degrees Fahrenheit or below and 140 degrees Fahrenheit or above, except during necessary periods of preparation and service.
