PURPOSE AND EFFECT: The purpose and effect of initiating rulemaking will be to begin the necessary dialogue among various interested stakeholders to discuss proposed amendments to the rules governing the Risk-Based Corrective Action (RBCA) process at contaminated sites in Florida. Further, amendments are needed to conform Ch. 62-780 to the procedures being developed simultaneously in Ch. 62-771 and Ch. 62-772, F.A.C., for state funded cleanup of petroleum contaminated sites.
SUBJECT AREA TO BE ADDRESSED: The subject areas to be addressed include the FDEP’s RBCA guidance documents, the site assessment process, fate and transport modeling and statistical methods, the risk assessment process, including the criteria for allowing the use of probabilistic risk assessment, and the criteria for achieving the “No Further Action” status at contaminated sites (with or without controls). Further, amendments are needed to address the new procedures that are being developed in Ch. 62.771 and 62-772, F.A.C., for state funded cleanup of petroleum contaminated sites.
