61J1-4.002: Equivalency Education

The Florida Real Estate Appraisal Board hereby gives notice of the issuance of an Order regarding the Petition for Variance, filed on January 24, 2013, by Van C. Sher. The Notice of Petition for Waiver or Variance was published in Vol. 39, No. 52, of the March 15, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on April 2, 2013. Petitioner sought a waiver or variance of paragraph 61J1-4.007(6)(c), F.A.C., in regards to the hour requirements for continuing education.

The Board’s Order, filed on April 29, 2013, denies the petition finding that Petitioner has not established that the Board’s full application of paragraph 61J1-4.007(6)(c), F.A.C., to his circumstances would violate principles of fairness and would impose a substantial hardship on him. Petitioner has not established that the purpose of the statute would be met by other means by the granting of the petition.
