    RULE NO.: RULE TITLE:

    69E-121.010: Indexing, Management, and Availability of Final Orders

    PURPOSE AND EFFECT: Rule 69E-121.010, F.A.C., was promulgated to comply with the previous requirement of Section 120.53, F.S., to maintain a subject matter index of agency final orders. In 2015, the Florida Legislature amended Section 120.53, F.S., to repeal this requirement and instead direct agencies to transmit their final orders to a centralized electronic database maintained by the Division of Administrative Hearings. Department of State Rule 1B-32.003, F.A.C., provides the standards and guidelines agencies must follow when transmitting final orders to the Division of Administrative Hearings. Therefore, Rule 69E-121.010, F.A.C., is no longer necessary and can be repealed.

    SUMMARY: The proposed rule will repeal Rule 69E-121.010, F.A.C., as it has been made unnecessary pursuant to Section 120.53, F.S. (2015), and Rule 1B-32.003, F.A.C.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: There is neither a cost nor an exemption from cost associated with this rule repeal. The repeal will reduce the number of unnecessary rules in the Florida Administrative Code.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
